These Terms & Conditions (“Terms”) govern your access to and use of our website located at www.baycitybike.com (the “Website”), including all reservations, purchases, products, services, and information available through the Website.

By accessing or using our Website, making a reservation, purchasing a gift card, contacting us, or otherwise interacting with our online services, you agree to be bound by these Terms.

If you do not agree with these Terms, please discontinue use of our Website.

These Terms apply to all visitors, customers, and users of the Website.

Bay City Bike Rentals & Tours is a family-owned bicycle rental and guided tour company located in San Francisco, California.

Since 2001, we have proudly provided visitors from around the world with bicycle rentals, electric bike rentals, guided bicycle tours, private tours, children’s bicycles, tandem bicycles, trailers, tag-alongs, baby seats, gift cards, and other visitor experiences.

Our Website is intended to provide information regarding our products and services, allow customers to make reservations, purchase gift cards, and communicate with our company.

4. Reservations

Reservations made through our Website are processed using FareHarbor, our third-party reservation platform.

Submitting a reservation request does not guarantee availability until the reservation has been confirmed.

Reservation confirmations remain subject to:

• Weather conditions 
• Operational requirements 
• Safety considerations 
• Payment authorization 

Bay City Bike Rentals & Tours reserves the right to:

• Decline reservations obtained through fraudulent activity. 
• Modify reservation times when reasonably necessary. 
• Substitute comparable equipment when required. 
• Cancel or modify reservations due to weather, safety concerns, mechanical issues, staffing, public events, government restrictions, or other operational circumstances beyond our reasonable control. 

Customers are encouraged to carefully review all reservation details immediately upon receiving their confirmation email and notify us promptly of any errors.

5. Rental Agreement & Liability Waiver

Every customer renting equipment or participating in a guided tour must complete the required Rental Agreement and Liability Waiver before bicycles or other rental equipment are released or tours begin.

Customers making online reservations may receive an email containing a secure link allowing the Rental Agreement and Liability Waiver to be completed electronically before arrival.

If the waiver has not been completed electronically, it must be completed at check-in before participation.

For participants under eighteen (18) years of age, a parent or legal guardian must complete and sign the required Rental Agreement and Liability Waiver.

Completion of an online reservation does not replace or eliminate the requirement to complete the Rental Agreement and Liability Waiver.

The Rental Agreement and Liability Waiver govern the rental transaction itself and should be read together with these Terms & Conditions. If there is any conflict between these Terms & Conditions and the Rental Agreement and Liability Waiver, the Rental Agreement and Liability Waiver shall control with respect to the rental transaction and participant responsibilities.

6. Bicycle Rentals

Bay City Bike Rentals & Tours rents bicycles and related equipment for recreational use throughout San Francisco and surrounding areas.

Rental periods begin when the bicycle or equipment is released to the customer and end when the equipment is returned and accepted by Bay City Bike Rentals & Tours.

Customers are responsible for all rented equipment during the rental period and agree to exercise reasonable care while using it.

Before leaving our location, customers should inspect the bicycle and any rented equipment to confirm that it is in proper working condition. Any concerns should be reported immediately so that we may inspect or replace the equipment if necessary.

If a mechanical issue develops during the rental period, customers should stop riding as soon as it is safe to do so and contact Bay City Bike Rentals & Tours for assistance. Customers should not continue operating equipment they believe may be unsafe.

7. Safety & Rider Responsibilities

Cycling is an outdoor recreational activity that involves inherent risks, including risks associated with traffic, road conditions, weather, other cyclists, pedestrians, and equipment operation.

Customers are responsible for operating bicycles safely and in accordance with all applicable federal, state, and local laws.

Each rider agrees to:

• Operate the bicycle in a safe and responsible manner. 
• Obey all traffic laws, signs, and signals. 
• Yield to pedestrians where required. 
• Ride only on routes appropriate for their experience and physical ability. 
• Avoid reckless or unsafe behavior. 
• Follow all instructions provided by Bay City Bike staff or tour guides. 
• Immediately report accidents, injuries, theft, or equipment damage to Bay City Bike Rentals & Tours. 

Helmets are provided with every bicycle rental. While California law may not require helmets for every rider, Bay City Bike Rentals & Tours strongly recommends that every rider wear a properly fitted helmet throughout the rental period.

Maps, suggested routes, and riding recommendations are provided solely as a courtesy. Customers remain responsible for selecting routes appropriate for their own experience, physical condition, weather conditions, traffic, ferry schedules, and road conditions.

8. Guided Tours

Bay City Bike Rentals & Tours offers guided public and private bicycle tours throughout San Francisco.

Tour routes, departure times, duration, stops, and itineraries are intended to provide the best possible experience; however, they may be modified without prior notice due to weather, construction, traffic conditions, public events, road closures, ferry schedules, or other operational or safety considerations.

Guests participating in guided tours agree to:

• Arrive sufficiently before the scheduled departure time. 
• Follow the instructions of their guide. 
• Ride responsibly and safely. 
• Respect other participants and members of the public. 
• Inform their guide of any medical or physical condition that may affect their participation. 

Late arrivals may not be accommodated if the tour has already departed.

Bay City Bike Rentals & Tours reserves the right to modify, delay, reschedule, or cancel tours whenever reasonably necessary for safety or operational reasons.

9. Minors

Bay City Bike Rentals & Tours welcomes families and offers bicycles and equipment designed for riders of various ages.

Reservations for minors must be made by a parent or legal guardian.

A parent or legal guardian must complete and sign the required Rental Agreement and Liability Waiver before any minor may participate in a bicycle rental or guided tour.

Parents and guardians are responsible for supervising minors throughout the rental period or guided tour unless otherwise specifically stated by Bay City Bike Rentals & Tours.

Nothing contained in these Terms modifies the requirements contained within the Rental Agreement and Liability Waiver.

10. Pricing, Availability & Equipment

Prices displayed on our Website are subject to change without prior notice.

Although we make every effort to maintain accurate pricing and inventory information, occasional errors may occur.

Bay City Bike Rentals & Tours reserves the right to correct pricing errors, typographical errors, or other inaccuracies before or after a reservation has been submitted. If a material pricing error affects an existing reservation, customers will be contacted and offered the opportunity to proceed at the correct price or cancel the reservation without penalty.

Availability of bicycles, equipment, tours, gift cards, and other services cannot be guaranteed until a reservation has been confirmed.

While every effort is made to provide the specific bicycle or equipment reserved, Bay City Bike Rentals & Tours reserves the right to substitute comparable equipment when necessary due to maintenance, safety inspections, mechanical issues, or other operational requirements.

All equipment is regularly inspected and maintained to help provide a safe and enjoyable experience for our customers.

11. Cancellations, Reservation Changes & Refunds

Reservations are subject to the cancellation, modification, and refund policies presented during the booking process.

Because cancellation policies may vary depending on the product or service reserved, customers should carefully review the applicable policy before completing a reservation.

Requests to modify or cancel reservations should be made as early as possible. While we will make every reasonable effort to accommodate changes, modifications are subject to availability and may not always be possible.

If Bay City Bike Rentals & Tours cancels a reservation due to weather, safety concerns, operational issues, or circumstances within our control, customers will be offered the remedies available under the applicable reservation policy.

12. Weather, Ferry Schedules & Operational Conditions

Bay City Bike Rentals & Tours operates outdoors, and weather conditions may affect bicycle rentals, guided tours, operating hours, recommended routes, and overall customer experience.

For the safety of our customers and employees, we reserve the right to modify, postpone, reschedule, or cancel rentals or tours when weather or other conditions make operations unsafe or impractical.

Recommended routes to Sausalito and other destinations may involve ferry transportation provided by independent ferry operators.

Bay City Bike Rentals & Tours is not responsible for:

• Ferry delays 
• Ferry cancellations 
• Schedule changes 
• Capacity limitations 
• Service interruptions 
• Fare changes 
• Decisions made by independent ferry operators 

Customers are encouraged to verify ferry schedules directly with the ferry operator before beginning their ride.

Road closures, construction, public events, traffic conditions, demonstrations, utility work, or other circumstances beyond our control may also require changes to recommended routes or tour itineraries.

13. Gift Cards

Gift cards purchased through Bay City Bike Rentals & Tours may be redeemed toward eligible rentals, tours, and other products or services offered by the Company.

Unless otherwise required by applicable law:

• Gift cards are non-refundable. 
• Gift cards are not redeemable for cash. 
• Lost, stolen, damaged, or unauthorized gift cards may not be replaced. 
• Promotional gift cards may be subject to additional restrictions disclosed at the time of issuance. 

Gift cards may not be used in violation of applicable law.

14. Right to Refuse Service

Bay City Bike Rentals & Tours is committed to providing a safe, enjoyable, and respectful environment for all guests and employees.

Accordingly, we reserve the right to refuse or discontinue service whenever reasonably necessary to protect our customers, employees, equipment, or the public, or when required or permitted by applicable law.

Examples include, but are not limited to:

• Failure to complete required rental documents. 
• Refusal to sign the Rental Agreement and Liability Waiver. 
• Unsafe or reckless conduct. 
• Intoxication or impairment. 
• Failure to follow staff instructions. 
• Conduct that may endanger other guests. 
• Fraudulent reservations or payment activity. 
• Abuse or harassment of employees or other customers. 
• Intentional damage to equipment or property. 

15. Intellectual Property

All content available on this Website—including text, photographs, videos, graphics, logos, maps, artwork, software, design elements, and other materials—is owned by Bay City Bike Rentals & Tours or used with permission.
